On May 21, Park Chun Hyuk, the lawyer for Well Made Star Ent, released an official statement.
He said, “Through a legal representative, Lee Sun Bin asked the agency to correct the violation of its exclusive contract and to comply with the terms as soon as possible. After several media inquired about this topic, we decided to make a formal statement. “
The first part of the statement states that the exclusive contract between Well Made Star Ent and Lee Sun Bin was signed in 2016 and that the contract has not expired. The agreement gave the agency exclusive management rights to Lee Sun Bin’s entertainment industry activities, and Lee Sun Bin is not authorized to promote or negotiate appearances without the agency’s prior consent.
The second part of the statement states that Lee Sun Bin sent the agency a unilateral termination notice in September 2018. The statement goes on to say, “Since then, it has violated its exclusive contract by continuing its activities in the entertainment industry independently. Lee Sun Bin has also damaged the reputation of the company and the company’s CEO by filing a false lawsuit. (The company received the verdict “not guilty” in the lawsuit in question.) “
The third part of the statement reads, “We asked Lee Sun Bin to quickly resolve the serious violations of her exclusive contract and sent her the following content certificate.” Content certification prompts Lee Sun Bin to provide the details of her September 2018 entertainment activities to date and disclose the income from these activities within 14 days of receiving notification.
The agency also requests Lee Sun Bin to disclose all of the productions in which she has been cast (including the upcoming OCN drama “Team Bulldog: Off-Duty Investigation”) and the productions for which she is negotiating. In addition, it must inform these parties that negotiations about the agency will take place in the future.
The fourth part of the statement states that the company will take legal action if Lee Sun Bin fails to meet the specified time frame.
Lee Sun Bin’s legal representative responded to the statement and denied the claims.
The response states: “On August 31, 2018, Lee Sun Bin sent a content certificate to her agency because the agency had no transparency about the expenses. She requested objective billing information and evidence to secure it, but the agency refused.
“Under the exclusive contract, the agency must use its management rights to maximize Lee Sun Bin’s talent and capabilities. You must give her the opportunity to prepare physically and mentally and to explain the content of her contract and schedule in advance. However, when Lee Sun Bin’s manager pointed out issues such as lack of transparency in accounting and signing offers without prior explanation, the company unilaterally downgraded the manager and reduced his salary. This affected Lee Sun Bin’s entertainment industry activities. “
The response further states that the agency did not respond to Lee Sun Bin’s certification of the content within 14 days, as set out in the exclusive contract. Following the procedure set out in the exclusive contract, Lee Sun Bin announced that her contract was terminated on September 21, 2018. For a year and eight months, the company did not issue a formal rebuttal of the contract termination. The company has sent no support for Lee Sun Bin’s entertainment activities and has confirmed the termination.
The answer continues: “In addition, the CEO of the agency sued Lee Sun Bin, claiming that he had forged paper. The CEO claimed they had never signed an exclusive contract with her. The publication of this new statement proves the inconsistency of his behavior. Lee Sun Bin was found not guilty of the fraud lawsuit against her.
“Despite all of this, the company continues to claim that Lee Sun Bin violated her exclusive contract. If we ask for details of the earnings she has generated between September 2018 and now, we can only see this as an attempt to lower Lee Sun Bin’s reputation. In addition, part of the lawsuit filed by Lee Sun Bin against the agency’s CEO addresses the agency’s violation of its contractual obligations. It is currently under investigation by prosecutors, so we cannot say the case has ended. Since the CEO also filed a lawsuit against Lee Sun Bin, the mutual trust relationship has already been broken. The judgment of the lawsuit does not change the fact that the contract has already been terminated.
“We urge the agency to stop taking actions that defame Lee Sun Bin’s reputation. If this behavior is not stopped, we warn that we will take legal action.”
